This website is operated by Tribute Capital Partners, LLC (“Tribute,” “we,” “us”), a Texas limited liability company. By using the site you accept these terms. If you do not accept them, do not use the site.
What this site is
The site describes what Tribute does and publishes our writing on consumer credit and bankruptcy. It is information, not advice, and not an offer. Read the Disclosures page, which forms part of these terms.
Using the site, sending us a message, or subscribing to an email list does not create a client relationship, an advisory relationship, or any duty on our part. Work begins only under a signed engagement agreement.
Who may use it
The site is intended for institutions and their advisors, and for people acting in a business capacity. You must be at least 18 years old. You agree to use the site lawfully.
Our content
Everything on the site — text, charts, photographs, code, layout, and the Tribute Capital Partners and Paper Trail names and marks — belongs to Tribute or to our licensors, and is protected by copyright and trade mark law. Underlying court data is not ours; see Disclosures.
What you may do
- Read, print, and save pages for your own business use.
- Quote a short extract, with attribution to Tribute Capital Partners and a link to the page it came from.
- Link to any page on the site.
- Share a chart or figure from the Consumer Bankruptcy Monitor in your own materials, with the same attribution and link, and without altering the figure or its labels.
What you may not do
- Copy the site, or a substantial part of it, for republication, redistribution, or resale, or to build a competing product or data set.
- Harvest the site in bulk — by crawler, scraper, or otherwise — beyond ordinary indexing, or at a rate that burdens the site.
- Use our names or marks in a way that suggests endorsement, or remove any notice of ownership.
- Probe, scan, or interfere with the site or its security, or try to reach any part of it that is not public.
- Send us anything unlawful, misleading, or infected.
Search engines and answer engines
We publish this material so it can be found and read, by people and by the assistants they use. Where our robots.txt file permits it, a search engine or an AI assistant answering a question for someone may read these pages and quote a short extract with attribution and a link. We publish an llms.txt file for that purpose. Reading a page to answer a question is not the same thing as copying the site, and the clause above is aimed at the second. The robots.txt file is the controlling statement of what automated access we permit, and it may be more restrictive on a test or preview deployment than on the live site.
What you send us
A form on this site is the start of a conversation, not a data room. The portfolio review form asks for portfolio-level facts, such as asset type, account count, and a balance band. We treat what you tell us there as confidential, and we use it only to scope the conversation.
Do not send anything more than that through a form. Loan files, data tapes, borrower information, account numbers, and anything else sensitive move under a non-disclosure agreement, by a route we agree with you.
If you send us a comment, suggestion, or idea about the site or our services, we may use it without obligation to you and without payment. You keep your own information; this applies to feedback.
Email list
The Paper Trail is free and opt-in. We may change what it covers, how often it arrives, or stop publishing it. You may unsubscribe at any time from the link in any issue.
Other sites
We link to sources, including court records and the sites of other organizations. Those sites are not ours. We do not control them, we are not responsible for them, and a link is not an endorsement.
Availability
We may change, suspend, or withdraw the site or any part of it at any time, without notice. We do not promise the site will be available without interruption or free of error.
No warranty
The site and everything on it are provided “as is” and “as available.” To the fullest extent the law allows, Tribute disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the content is accurate, current, or complete. Market and legal conditions change, and a page may be out of date by the time you read it.
Limitation of liability
To the fullest extent the law allows, Tribute and its members, officers, and employees are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost recoveries, lost data, or business interruption, arising out of your use of this site or your reliance on anything in it. Our total liability for all claims relating to the site is limited to one hundred United States dollars (US$100). This limit does not apply to liability that cannot be limited by law, and it does not affect a separate signed engagement agreement, which governs that work on its own terms.
Indemnity
You agree to indemnify Tribute against any claim, loss, or expense, including reasonable legal fees, arising from your use of the site in breach of these terms or of any law.
Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and Tribute agree that any dispute arising out of the site or these terms will be brought only in the state or federal courts sitting in Dallas County, Texas, and you consent to the jurisdiction of those courts.
General
If a court finds any provision unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, with the Privacy Policy and the Disclosures, are the whole agreement between you and Tribute about the site.
Changes to these terms
We may change these terms. The current version is always on this page, with the date it took effect at the foot. Using the site after a change means you accept it.
