Disclosures
What the information on this website is, what it is not, and where it comes from.
Draft — this page is pending review by counsel and is not legal advice.
These disclosures apply to every page of this website, to The Paper Trail, and to the Consumer Bankruptcy Monitor. They form part of our Terms of Use.
Information, not advice
Nothing on this site is legal, accounting, tax, investment, or regulatory advice, and nothing on it is a valuation of your portfolio. We write for a professional audience about a technical subject, in general terms. Your portfolio, your charter, your examiner, and your facts are specific to you.
Do not act on anything here without advice from your own counsel, accountants, and advisors. In particular, an accounting position under CECL is management's to select and support, and nothing on this site substitutes for that work or for your auditor's judgment. Reading this site, or writing to us through it, does not create a client, advisory, or fiduciary relationship. Work begins only under a signed engagement agreement.
No offer or solicitation
This site is not an offer to buy or sell any loan, portfolio, receivable, security, or other asset, and it is not a solicitation of any such offer. It is not an offer to lend. Any transaction with Tribute is made only through definitive written agreements, after diligence, and on the terms stated in those agreements. A price, a bid, or an indication of interest is given in writing, for a named portfolio, and is subject to the conditions it states.
Forward-looking statements
Some of what we publish looks ahead: where filings are heading, how a credit cycle may turn, what recoveries a portfolio might produce. Those statements rest on assumptions and on information available when we wrote them. Conditions change, assumptions fail, and outcomes differ — often materially. We do not undertake to update a forward-looking statement after it is published.
Figures, results, and past performance
Figures describing Tribute — including the number of creditors served and years in business — are drawn from our own records. They are approximate, they are current as of the date at the foot of this page, and they are not audited by a third party.
Any result we describe was produced in a particular engagement, for a particular portfolio, in a particular market. Recovery on consumer receivables depends on asset type, seasoning, status mix, geography, documentation, servicing quality, and the economy. Past performance does not indicate or guarantee future results, and no result described here should be read as a projection or a promise of what your portfolio will do.
SOC 2 Type II
Tribute holds a SOC 2 Type II report on its servicing operation. A SOC 2 Type II report is an independent auditor's opinion on whether stated controls were suitably designed and operated effectively over a defined period. It is not a certificate, a license, an accreditation, or a government approval, and no body issues a "SOC 2 certification."
The report covers the servicing operation and the period it names. It does not cover this website, it does not cover work outside its stated scope, and it is not a warranty of any outcome on your portfolio. Where this site describes the operation as SOC 2 Type II audited, it means this report and nothing more. We provide the current report under a non-disclosure agreement during diligence, so your vendor-management file holds the auditor's own words rather than ours.
Third-party data
The Consumer Bankruptcy Monitor is built from the bankruptcy statistics published by the Administrative Office of the United States Courts at uscourts.gov, together with other public sources we name. We do not control that data, we did not produce it, and we do not warrant that it is accurate or complete. The courts revise their tables, restate earlier periods, and change their file formats and layouts. Our methodology page records every source file we used, with its date and checksum, so you can check our work against the original.
Tribute is not affiliated with, endorsed by, or sponsored by the United States Courts, the National Credit Union Administration, or any other government body or agency. Where we cite another organization's research, the citation is not an endorsement by them of us, or by us of them.
Opinions
The Paper Trail and our Insights carry the observations and opinions of their authors at the time of writing. They are not the position of any client, and they may not be the position of Tribute tomorrow.
